Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the HeyHomie mobile app, website, and related services (together, the “Service”), operated by HeyHomie (“HeyHomie,” “we,” “us,” or “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What HeyHomie Is

HeyHomie is a gamified learning app that teaches crypto, blockchain, and Solana/DeFi concepts through bite-sized lessons, quizzes, XP, streaks, badges, quests, and a leaderboard. Any swap, stake, or trading “demo” you interact with inside a lesson is a simulation for teaching purposes only — it does not move real funds and is not connected to any live market or protocol.

HeyHomie does not execute trades, swaps, staking, lending, or any other financial transaction on your behalf, and the Service does not provide brokerage, custody, or trading functionality of any kind.

2. Your Wallet

Depending on how you sign in, HeyHomie may create a non-custodial embedded wallet for you (via our authentication provider, Privy), or you may connect an existing Solana wallet app (such as Phantom, Solflare, or a Seeker device’s Seed Vault) using the Solana Mobile Wallet Adapter. Either way:

• HeyHomie is non-custodial. We never hold your funds, and nothing in the Service can move assets out of your wallet.
• Your wallet is used to identify your account, hold any completion certificates you earn, and (if you connect an external wallet) to sign a one-time sign-in message. We do not request or need a transaction signature that transfers value out of your wallet.
• You are solely responsible for safeguarding your device, credentials, passkeys, and any recovery method associated with your wallet.
• Anything you hold in your wallet outside of HeyHomie, and anything you do with your wallet outside the Service, is entirely your own responsibility.

3. Completion Certificates

When you finish a full learning path, HeyHomie may mint a free on-chain completion certificate (a compressed NFT on Solana) to your wallet. HeyHomie’s server pays the network fee for this — you are never asked to sign or pay for it. Certificates carry no monetary value, are not an investment, and are not guaranteed to be transferable, tradeable, or to retain any value or utility. HeyHomie may modify, pause, or discontinue the certificate program at any time. Once minted, a certificate is recorded on the public Solana blockchain and cannot be recalled or deleted by HeyHomie.

4. Not Financial, Investment, or Legal Advice

Nothing in the Service is financial, investment, tax, or legal advice. HeyHomie is not a broker-dealer, exchange, custodian, or registered investment adviser. All lessons, quizzes, and simulations are provided for educational purposes only.

5. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you should have a parent or guardian’s permission. By using the Service, you represent that you meet these requirements and that you are not located in, or a resident of, any country or region subject to comprehensive sanctions.

6. Subscriptions

HeyHomie Pro is an optional subscription that unlocks the full curriculum, removes ads, and adds streak protection. Subscriptions are billed and managed through the Apple App Store or Google Play, as applicable, and are subject to that platform’s payment, renewal, and refund terms — HeyHomie does not process your payment details directly and cannot issue refunds on the platform’s behalf.

7. Acceptable Use

You agree not to:

• Use the Service to violate any law.
• Manipulate, automate, or otherwise cheat the leaderboard, XP, streak, quest, or referral systems.
• Attempt to gain unauthorized access to the Service, other users’ accounts, or our infrastructure.
• Reverse-engineer, scrape at scale, or interfere with the normal operation of the Service.

8. Third-Party Services

The Service relies on third-party infrastructure we do not control, including wallet and sign-in infrastructure, the Solana network, and app-store billing. We are not responsible for the availability, security, or conduct of these third parties.

9. Intellectual Property

The Service, including its lessons, design, text, graphics, and underlying software, is owned by HeyHomie or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use, subject to these Terms.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE ACCURATE, UNINTERRUPTED, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEYHOMIE AND ITS TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

12. Indemnification

You agree to indemnify and hold HeyHomie harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, including for suspected violation of these Terms. You may stop using the Service at any time.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Effective” date above and, where appropriate, notify you in the app. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which HeyHomie is established, without regard to conflict-of-law principles, unless otherwise required by applicable local law.
